Carlyn Irwin has nearly twenty years of litigation consulting experience, including analyzing financial, economic, and accounting issues; analyzing and preparing damages claims; conducting financial forensic analysis; and providing expert witness testimony. She is also experienced in conducting consumer surveys. Ms. Irwin has worked with clients and counsel throughout the litigation process on complex commercial disputes. Examples of her casework include:
- Intellectual property disputes—Addressing damages issues in patent, trademark, and copyright infringement and trade secret misappropriation disputes in a broad range of industries, including medical devices, defense contracting, computer and Internet-based technology, entertainment, and consumer products. She has specific expertise in estimating lost profits, unjust enrichment, and reasonable royalty damages, including analysis of causation and apportionment issues.
- Contract and tort claims—Analyzing causation and damages issues in breach of contract and tort causes of action, including breach of fiduciary duty, false advertising, and unfair business competition (e.g., California BPC Section 17200 claims) in industries such as real estate development, consumer products, Internet-related businesses, technology, communications and broadcasting, and financial and professional services.
- Financial forensic analysis—Reconstructing financial records, tracing transactions through corporate reporting systems, and reviewing financial records (including tax returns) to assess consistency and reliability as part of complex civil litigation involving allegations of fraudulent conveyances, breach of contract, and fraud.
- Litigation support—Working with clients and attorneys during all phases of the litigation process, including document and data requests and production, depositions, mediations, settlement conferences, arbitration proceedings, and trials.
Ms. Irwin is a certified public accountant, certified in financial forensics, and is a certified fraud examiner.
