Overview
For more than twenty years Cornerstone Research and its in-house and affiliated experts have provided consulting and expert testimony in hundreds of intellectual property matters. Our experience in intellectual property litigation spans a wide range of issues, including allegations of patent, copyright, and trademark infringement, as well as matters involving theft of trade secrets and breach of technology agreements.
To address the wide range of issues that arise in intellectual property litigation and licensing, Cornerstone Research uses a multidisciplinary approach that combines economic, marketing, finance, and accounting expertise as well as industry perspectives. We formulate and evaluate damages claims, which can require assessing loss causation, lost profits, reasonable royalties, unjust enrichment, and prejudgment interest. In addition, we assess liability issues such as antitrust counterclaims, commercial success, and customer confusion. Cornerstone Research has experience providing economic analysis related to injunction requests, including irreparable harm, and assessment of whether there is a domestic industry and other economic issues in cases before the International Trade Commission.
Cornerstone Research experts and affiliated academic and industry experts have testified in numerous trials or arbitration hearings and myriad depositions, in leading U.S. District Court venues—such as California, Delaware, New York, Texas, and Virginia—as well as before the United States International Trade Commission, the American Arbitration Association, and state courts.
