The defense retained Dr. Michael Keeley of Cornerstone Research in this breach of technology sharing matter. Telebit had purchased ParaData’s computer communication technology, agreeing to pay royalties based on the sales of Telebit’s product. Subsequently, ParaData alleged that Telebit had failed to devote its best efforts to developing and selling the product, and therefore owed ParaData for lost royalties. Dr. Keeley testified in deposition that Telebit had every incentive to develop the technology, that it had devoted disproportionately high resources to the product, and that low sales were attributable to market conditions. Moreover, he showed that ParaData could have mitigated any damages by agreeing to buy back the technology. The case settled.
