Brad Howells focuses on economic and statistical analysis in complex matters involving antitrust and competition, as well as labor and employment. Dr. Howells has particular experience in merger reviews and litigation, and healthcare. He works with clients and experts through all phases of litigation, including deposition and trial.

Merger reviews and litigation

Dr. Howells consults on cases for both merging parties and government agencies. He has worked on proposed transactions in numerous industries, including distribution, healthcare, health insurance, high-tech manufacturing, telecommunications, and railroads. His experience includes multiple U.S. merger trials, including T-Mobile/Sprint, FTC v. Sysco/US Foods, U.S. v. Aetna/Humana, and FTC v. Wilhelmsen/Drew, as well as preparing for litigation and trial in USA v. Cabell Huntington Hospital Inc./St. Mary’s Medical Center Inc.

Antitrust and competition

Dr. Howells analyzes class certification, liability, and damages issues in a range of competition-related matters. He has consulted on issues involving alleged horizontal price fixing, vertical exclusionary practices, and attempted monopolization/monopsony. Dr. Howells’s work in antitrust litigation spans many industries, including food and agriculture, healthcare, distribution, and consumer products.

Labor and employment

Dr. Howells has worked on high-profile labor matters involving class certification, discrimination, and employee/independent contractor status.

American Bar Association Section of Antitrust Law

An active participant in the ABA Section of Antitrust Law, Dr. Howells has served as the Young Lawyer/Economist Representative to the Pricing Conduct and the Health Care and Pharmaceutical Committees. He has contributed to several ABA publications and programs.
