This article discusses three recent cases in which athletes brought lawsuits related to NIL.

In 2025, the National Collegiate Athletic Association (NCAA) entered into a multibillion-dollar settlement that provided back pay to former college athletes who had competed since the 2016–2017 season. In the wake of this settlement, several athletes who competed in earlier seasons (and were therefore excluded from this settlement) have brought lawsuits seeking similar compensation.

In this article, author Matthew Calvin discusses and compares three such cases. Each has been dismissed in District Court for being untimely and the Second Circuit upheld one of these dismissals mid-last month.

The article was originally published by the American Bar Association’s Antitrust Law Section in the Trade, Sports and Professional Associations Committee newsletter.
