Reference Manual on Scientific Evidence: Economic Damages

Share

Coauthors contribute to reference guide that examines pivotal issues subject to dispute, discussing assessment of a case’s needs and evaluating experts and data.

Mark Allen, Carlos Brain, and Filipe Lacerda of Cornerstone Research coauthored the chapter titled “Reference Guide on Estimation of Economic Damages” in the Reference Manual on Scientific Evidence.

This chapter identifies areas of dispute that arise when economic losses are at issue in legal proceedings, focusing on explaining the issues rather than taking a position on the proper resolution. The authors discuss the application of economic analysis within established legal frameworks for damages, cover topics in economics that arise in measuring damages, and provide relevant case examples.

The Reference Manual on Scientific Evidence is a joint product of the Federal Judicial Center and the National Academies of Sciences, Engineering, and Medicine. For three decades this manual has assisted judges in considering various types of statistical and scientific evidence offered in litigation to bring about better and fairer legal decisions.

The fourth edition of the Reference Manual on Scientific Evidence was published in December 2025.
