The authors discuss key questions at the intersection of generative AI and intellectual property.

As Generative AI tools transform our workflows, questions at the intersection of AI and copyright are requiring a reexamination of our IP system. The U.S. Copyright Office (USCO) has undertaken a Copyright and AI initiative to address these questions. In August 2023, the USCO issued a Notice of Inquiry (NOI) to study issues related to copyright and AI and received 10,371 comments from practitioners, academics, subject matter experts, and members of the general public.

In an article for IP Watchdog, coauthors Kirti Gupta and Elias Ilin, with support from Cornerstone Research’s Data Science Center and the firm’s large language model (LLM), conducted a sentiment analysis of these comments. This analysis helps to identify the existing gaps in the USCO’s current guidance and a framework for how to shape further guidance.
