In a matter involving electronic coupons, e-centives was sued by coolsavings for patent infringement. Counsel for e-centives retained Cornerstone Research and Professor Ward Hanson of Stanford University to assess the validity of coolsavings’ patent. We analyzed prior patents, the marketing and Internet business literature of the time, and company marketing documents, and concluded that the technology claimed in coolsavings’s patent was obvious. The case settled.
