Cornerstone Research staff and experts have applied finance and investments knowledge and data analytics experience to class certification issues in dozens of ERISA matters. We have addressed a range of issues including conflicts of interest, named plaintiff standing, and challenges in calculating classwide damages. These matters have included Ann I. Taylor et al. v. KeyCorp et al. and Johnson et al. v. Evangelical Lutheran Church in America et al.

Work in these cases often involves analysis of large-scale, individual-level transaction datasets. We have considerable expertise in working with and evaluating individual account-level transaction data across a range of plans, including:

  • Defined contribution plans such as 401(k)s
  • Cash balance plans
  • Retirement annuities
  • “Top hat” plans
  • Bonus and other deferred compensation plans that are not subject to ERISA regulations
