Defense counsel for a large brokerage firm jointly retained Cornerstone Research and a number of testifying experts in a gender discrimination class action. The putative class comprised all female retail brokers working at the U.S. offices of the firm. The class alleged gender discrimination via a number of mechanisms related to compensation and the growth of brokers’ books of business. Cornerstone Research collected and analyzed detailed data on all of the firm’s brokers, including their personal characteristics, how their books grew and developed, and how their compensation was determined. Our analysis demonstrated that the plaintiffs’ allegations could not explain any observed compensation differences between male and female brokers, and that the claims of gender discrimination could not be addressed on a class-wide basis. The case settled.
