The GeneChip, a product that combines semiconductor manufacturing technology and DNA research, is used to analyze complex genetic information for use in biomedical research. Oxford Gene Technology (OGT) alleged that Affymetrix’s process for making its GeneChip infringed OGT’s patents.
Dr. Gene Brown served as the expert witness on behalf of Affymetrix. Dr. Brown reviewed licensing agreements within the biotechnology and related industries to determine a reasonable royalty rate on the technology covered in the disputed patents. He also evaluated the opposing expert’s report and outlined several significant flaws in its methodology. The case settled on confidential terms, and all pending lawsuits were dismissed.
