Our client won an injunction in this breach of contract matter based on testimony from Dr. Kirti Gupta.

Cloud Software Group (CSG) sought to invalidate a long-running software licensing agreement with Revvity Signals Software (Revvity) by claiming that Revvity breached the agreement. Revvity filed a complaint against CSG in Massachusetts Superior Court seeking enforcement of CSG’s obligations to Revvity.

Revvity won a permanent injunction in part due to Dr. Gupta’s testimony that it would be difficult to quantify all of the monetary losses Revvity would incur without an injunction.

Counsel for Revvity retained Kirti Gupta of Cornerstone Research to analyze claims related to irreparable harm and quantifiable damages Revvity would suffer if CSG were permitted to invalidate the agreement.

Dr. Gupta testified on a broad set of topics, including lost profits damages, management forecasts of earnings, variable costs and expenses, discounting, product and customer stickiness, switching costs, and the importance of reputation in certain high technology sectors.

In February 2025, Revvity won a permanent injunction. This was based, in part, on Dr. Gupta’s testimony that it would be difficult to quantify all of the monetary losses Revvity would incur without an injunction.
