Counsel for Connectix retained Dr. Michael Keeley to analyze the economic issues in this copyright infringement case. Connectix produced software that allowed users to play Sony PlayStation video games on their computers. Sony charged that Connectix’s copying of the PlayStation BIOS system during its reverse engineering process did not constitute fair use. Dr. Keeley showed that Sony actually benefited from sales of the Connectix software, and that the balance of hardships weighed against a preliminary injunction. All of the copyright and trademark claims in this suit were dismissed.

In a second phase of the case, Dr. Keeley was asked to assess the damage Connectix incurred as a result of the injunction Sony had obtained. The case settled.
