The Nature Company accused Natural Wonders of infringing its trade dress. Counsel for the defense retained Cornerstone Research to assess whether the Nature Company’s trade dress was functional or inherently distinctive, and whether customers were confused by the two stores’ purported similarities. We also analyzed the companies’ economics and assessed the validity of the plaintiff’s royalty-based damage claim. The case settled.
