Kevin Hsueh consults on matters related to media and entertainment disputes, securities litigation, and insurance and pension plans. Dr. Hsueh also has experience with accounting, valuation, corporate transaction, and derivative litigation, including cases in the Delaware Court of Chancery.

Media and entertainment

Dr. Hsueh has particular experience with commercial disputes in the media and entertainment industry, with a focus on intellectual property (IP), contract issues, and industry analysis in high-profile matters.  Representative work includes:

  • Consulting on issues related to contract disputes and IP, including film and music copyright litigation
  • Analyzing damages claims in trademark and copyright infringement matters in state and federal courts
  • Evaluating sector-specific trends and company performance across a range of high-stakes disputes
Securities

Dr. Hsueh analyzes economic issues under Section 10(b) of the Securities Exchange Act of 1934, Sections 11 and 12 of the Securities Act of 1933, and shareholder derivative suits. His relevant experience includes:

  • Assessing potential economic exposure at different stages of the litigation process
  • Evaluating market efficiency, price impact, and Comcast issues at the class certification phase and inflation, loss causation, and damages issues at the merits phase
  • Analyzing the outcomes of potential settlements
Insurance and pension plans

Dr. Hsueh assesses complex actuarial and financial issues related to insurance and pension plans, including:

  • Valuing pension liabilities and analyzing multiemployer pension plans (MEPPs), such as the potential financial impact of withdrawals
  • Assessing allegations of misstated insurance liabilities due to inappropriate actuarial assumptions and loss reserving practices
  • Analyzing premium rates for personal automobile insurance during the COVID-19 pandemic
