Kevin Oswald consults on a wide range of complex liability and damages matters, with a focus on the insurance and consumer finance industries. Mr. Oswald consults to clients and supports experts through all phases of commercial litigation, including class certification, merits, deposition testimony, mediation, and trial.

Insurance and pension plans

Mr. Oswald is a credentialed actuary and a leader in Cornerstone Research’s insurance and pension plans practice. He addresses issues related to property & casualty insurance, life insurance, health insurance, and reinsurance, as well as pension plans. His experience includes:

  • Evaluating allegations of misstated insurance liabilities due to inappropriate actuarial assumptions and loss reserving practices
  • Assessing asset and liability management (ALM) issues
  • Evaluating insurance company surplus levels and other financial health metrics, such as risk-based capital (RBC)
  • Conducting asset adequacy analysis (AAA) for long-term liabilities, such as those associated with long-term care (LTC)
  • Analyzing personal automobile insurance premium rates during the COVID-19 pandemic
  • Valuing pension liabilities and analyzing multiemployer pension plans (MEPPs), including the potential financial impact withdrawals or mass withdrawals
Consumer finance

Mr. Oswald analyzes financial and economic issues involving such consumer financial products as mortgages, student loans, and personal loans. His experience includes:

  • Analyzing a mortgage lender’s potential exposure related to alleged fair lending violations
  • Assessing alleged discriminatory impact of a financial institution’s real estate owned (REO) property practices
  • Developing econometric models to determine how changes to loan default policies affected a student loan servicer
  • Evaluating forbearance practices for a student loan servicer
