Education

Ashish Pradhan has more than a decade of experience addressing complex consumer fraud and product liability, consumer finance, and intellectual property matters. Mr. Pradhan also analyzes other finance issues, particularly those involving real estate and corporate governance. He has worked on multiple class actions, at both the class certification and merits stages. Mr. Pradhan has also given presentations and published articles on these topics.

Mr. Pradhan has consulted on a range of high-profile matters and supports attorneys and experts in state and federal courts, as well as mediation and arbitration. His industry expertise includes automobiles, entertainment, high tech, music, retail, social networking, and video games.

Consumer fraud and product liability

Mr. Pradhan has led teams in product liability matters involving alleged automotive defects, including Beaty v. Ford Motor Company and In re General Motors LLC Ignition Switch Litigation. He has designed and executed surveys, evaluated survey data, conducted content analyses, and performed other market-based research to assess the scope and claimed impact of the alleged defects. In addition, Mr. Pradhan addresses alleged misrepresentations in cases arising in industries such as consumer products, high tech, and mobile phones.

Intellectual property

Mr. Pradhan’s expertise spans a variety of intellectual property issues, including trade secrets, patents, copyrights, and trademarks. He has substantial experience with cases involving remedies, notably lost economic profits, unjust enrichment, reasonable royalty damages (including reasonable and nondiscriminatory, or RAND, royalties), and injunctive relief. Mr. Pradhan has also addressed liability issues. Many of the matters on which he has consulted have involved employee movement between competing companies, or allegations that employees misappropriated confidential information to start a competing venture. Mr. Pradhan analyzed lost profits and reasonable royalties in Activision v. Electronic Arts, a breach of contract case involving the publisher and developers of the video game “Call of Duty.” He also worked on such landmark cases as Move Inc. v. Zillow Inc. and Microsoft v. Motorola.

Finance

Mr. Pradhan has extensive experience in consumer finance cases. In consumer class actions and other matters, he has analyzed issues involving home mortgages, appraisals, overdraft fees, and short-term credit products such as payday loans.

Mr. Pradhan coheads Cornerstone Research’s corporate governance practice. He has supported experts who have opined on the duties of corporate directors and officers, alter ego/piercing the corporate veil, and disclosures. He also has worked on many cases involving real estate issues.

Marketing

Mr. Pradhan has substantial expertise with a range of marketing analyses related to consumer behavior, advertising, branding and brand value, and customer profitability. He has applied these techniques in consumer fraud and product liability and intellectual property matters.
